SPEAKER 2
We had some major Supreme Court rulings that dropped on Friday. We'll go over them all, especially the nationwide injunction case involving birthright citizenship. What are the implications? What happens next? We'll break it all down. California Governor Gavin Newsom files a massive defamation lawsuit against Fox News. What are the causes of action? Where is that lawsuit going next?
0:26
I had the opportunity to speak with California Governor Gavin Newsom. He broke down the case with me, Michael Popak, and I will discuss. We're also seeing more disbarments of Donald Trump's former lawyers. Is this basically a sign that this is what's going to happen with the current band of
0:45
of bandits basically that Donald Trump is, uh, surrounding himself with. And also Donald Trump threatening to sue CNN and New York times for defamation for reporting on the intelligence community, uh, in the United States and in Europe, frankly, saying that the strikes on Iran were not as successful as Donald Trump claimed when Donald Trump says total obliteration.

PROTECT YOUR UNIONS AND IF YOU DON'T HAVE ONE START ONE NOW. YOU WILL HAVE BETTER BENEFICTS AND INSURANCE AND RETIREMENT, PLUS WAGES.

During his first term, Donald Trump installed a Postmaster General who wanted to privatize the USPS, along with enough members of the Postal Board that that Postmaster could not be fired by Joe Biden.

Now, Trump is back in the White House―and his privatization plans are so extreme that even Postmaster General Louis DeJoy wanted no part of it. DeJoy resigned, and now he’s eyeing a FedEx board member to replace DeJoy. If David Steiner is confirmed, there will be nothing holding Trump’s privatization scheme back.

Our mail is sorted and delivered by more than 500,000 union members, mostly represented by the National Association of Letter Carriers and the American Postal Workers Union. If Trump succeeds in privatizing the USPS, those workers would be laid off and replaced with non-union contractors. We can’t let that happen!

Tell the USPS Board of Governors: Don’t nominate privatizer David Steiner as Postmaster General!

During DeJoy’s tenure, he rolled out a system of price increases and delays that make the mail slower, less reliable, and more expensive. Now, Trump is crashing the economy and could try to roll USPS privatization into any recovery plan as a “necessary hardship,” even when that was his intention all along.

Privatization wouldn’t just mean lost jobs―it means higher costs, reduced access, and the total elimination of mail services in areas where private companies refuse to deliver. For rural Americans, this isn’t just inconvenient, it’s catastrophic.

Tell the USPS Board of Governors: Don’t nominate privatizer David Steiner as Postmaster General!

In solidarity,

The Labor Force

Will the coalfields ‘get over’ losing hospitals miners fought to create?

Kentucky Sen. Mitch McConnell told his colleagues behind closed doors this week that “failure is not an option” when it comes to passing their bill to deeply cut health, nutrition and education programs to fund tax cuts skewed to the wealthy. “I know a lot of us are hearing from people back home about Medicaid,” he told fellow senators. “But they’ll get over it.”

“Getting over it” will be hard in Kentucky, where the budget reconciliation bill is estimated to take health care from over 200,000 Kentuckians. Crucially, it also puts 35 rural Kentucky hospitals at risk of closure, more than any other state and 10% of the vulnerable hospitals across the entire country. These facilities depend heavily on the payments from Medicaid-covered patients to make emergency and specialty care available to everyone in the community.

Among the Kentucky hospitals that could shutter are five of the seven original Miners’ Memorial Hospitals set up by the United Mine Workers of America (UMWA) in 1956. Those facilities — in Whitesburg, Middlesboro, Harlan, South Williamson and McDowell — are on the chopping block, along with Eastern Kentucky hospitals in Prestonsburg, Manchester, Louisa, Corbin, Mt. Sterling, Pineville, Irvine, Martin and Barbourville.

Coal mining has always been dangerous, but before the UMWA the work was brutal. Deaths and injuries were frequent, children worked in the mines, and pay was in the form of credit at the company store. It took often-bloody battles for the workers to win their union and a chance at a better life.

The UMWA Welfare and Retirement Fund, created through successful contract victories, built the Miners’ Memorial Hospitals to provide health care in coal communities where it was sorely lacking. But mechanization of coal mining led to deep job losses by the 1960s, and the UMWA was forced to sell the facilities to a nonprofit that eventually became Appalachian Regional Healthcare (ARH).

ARH and other Eastern Kentucky hospitals continue to provide everything from birthing to cancer care, and offer surgery, cardiology, physical and occupational therapy and family medicine. Rural people already travel much farther than others for health care and driving even longer distances due to shuttered hospitals will mean missed appointments and delayed treatment. That’s the difference between good health and bad, and between life and death.

The Sheps Center for Health Services Research at the University of North Carolina reports that 196 rural hospitals have closed or converted since 2005, but Kentucky has been largely spared thanks to the funds provided by Medicaid expansion through the Affordable Care Act. Kentucky lost four rural hospitals over those 20 years, while neighboring Tennessee — which did not expand Medicaid — lost 15.

ARH is the single largest employer in southeastern Kentucky, making potential Medicaid cuts a jobs issue as well. Health care and social assistance is the biggest industry in the Eastern Kentucky workforce area, employing 26,585 people or 25% of all jobs. And many other jobs in the region, like in retail (16,580 jobs) and government (23,192), depend on the spending and taxes of these hospitals’ nurses, therapists, physicians, technicians and more.

The threat to rural hospitals from proposed Medicaid cuts is a major point of contention over the bill. Some are floating the Band-Aid of a “rural hospital fund” that will only address a tiny fraction of the problem and is more a talking point than a solution.

Eastern Kentucky miners fought and died to create a health care system in a region where the market never would have on its own. Now members of Congress threaten to take it away.

It’s to them, now, that the song penned during the union mine wars in Harlan County asks: “Which side are you on?”

Coal will never come back. Republicans only tell this to people in WVA and Eastern Kentucky to get votes so Republicans can get richer as a Congressperson or a US Senator.

Start voting for Democrats, and if they don't do as you ask them, vote against them next Election

Former Trump golf club worker was sexually harassed by supervisor, then conned into signing illegal NDA, lawsuit says

Trump attorney Alina Habba duped Alice Bianco into signing the non-disclosure agreement in 2021, according to a suit filed this week in New Jersey.

excerpt:

A former server at Donald Trump's New Jersey golf club says a Trump attorney duped her into signing an illegal non-disclosure agreement and settling a sexual harassment claim against her supervisor for a "paltry sum."

In a lawsuit filed Wednesday in New Jersey's Middlesex Superior Court, Alice Bianco said attorney Alina Habba acted unethically by portraying herself as a friend and "neutral" ally after she learned that Bianco had alleged her boss was harassing her at Trump National Golf Club in Bedminster. Habba began representing Trump publicly soon after the NDA was signed in August 2021, according to the suit.

Habba on Thursday denied the allegations against her in the lawsuit, which was first reported by Politico.

Can a President pardon an attorney who has been disbarred?

Expand full comment
Jessie's avatar

PRESIDENTIAL PARDONS only apply to FEDERAL CRIMINAL CONVICTIONS.

Attorneys are granted credentials by STATES.

LEGAL CHARGES brought against CHESEBRO were in STATES

In an order obtained by Lawfare's Anna Bower on Thursday, a panel of judges noted that Chesebro had pleaded guilty to conspiracy to file false electors in Georgia.

The panel ordered that Chesebro "is disbarred and his name is stricken from the roll of attorneys and counselors-at-law of the State of New York, effective immediately."

The attorney was "commanded to desist and refrain from the practice of law in any form in the State of New York, either as principal or as agent, clerk or employee of another; and respondent is hereby forbidden to appear as an attorney or counselor-at-law before any court, judge, justice, board, commission or other public authority, or to give to another an opinion as to the law or its application, or any advice in relation thereto, or to hold himself out in any way as an attorney and counselor-at-law in this State."

Chesebro was also facing charges in Wisconsin and was said to be cooperating in a fake electors investigation in Arizona.

The attorney was first suspended from practicing law in New York in 2024.

I'm listening to the audio version of the book, The Privatization of Everything. Now it's all starting to make sense: Remove public goods like water, schools and prisons from public control by promising cost savings due to "efficiency," gut the services and rake in the cash. Look at the cities that contracted with private companies for taking over their water infrastructure, for example. A number of cities, after finding that water rates went up faster than ever and/or that promised infrastructure improvements were shoddy or not done at all, terminated their contracts (usually at extra cost and/or with litigation) because doing so would actually SAVE money. Of course private detention centers don't want to let legislators or anyone else to come in unannounced; they save money by violating basic human rights. That's how they make their profits. Oh, and for regular prisons, you can also use the labor of the prisoners and pay them next to nothing. And "job training" and "job placement" means teaching people how to get low-wage jobs, not helping inmates increase their skills more than just a bit if at all.

I believe that when we finally look back on all this, you will see how important this episode of Legal AF is. I am not glad to say it but Ben nailed it on this episode when he concluded his discourse by stating that we ARE now living in a dictatorship, we have crossed that threshold and we can now see that all 3 branches of government are conspiring against us: The White House is controlled by Trump and his MAGA sycophantic followers; Congress continues to be docile and compliant with the wishes of the White House; and now the handwriting is on the wall, SCOTUS is willing to shred all the decades of legal precedent we have grown accustomed to thinking of as a bulwark to our democracy, to our fundamental freedoms and the rule of law. It seems abundantly clear that WE THE PEOPLE must not now shirk our responsibilities to protect the Constitution from ENEMIES BOTH FOREIGN AND DOMESTIC since the elected representatives who we have, willy nilly, installed in our government are now unable to adequately represent our interests nor uphold our laws and the Constitution itself‼️ WE MUST STAND UP AS A UNIFIED BODY AND ONCE AGAIN THROW OFF THE BONDS OF TYRANNY THAT WE ARE NOW EXPERIENCING ALL ACROSS AMERICA 🇺🇸 ‼️

In closing I just want to Thank You 🙏🏼 both for shining the light of truth on our current situation and clearly articulating what I have been fearing for months, since February at least: That our government has become a fascist dictatorship and we can no longer trust the Supreme Court to rule in anyone’s favor except Trump’s‼️

I agree with Ben that we are at a fork in the road, an inflection point in history, and we must now carefully consider our next steps because whichever path we choose is heading for danger‼️ Furthermore, if we sit back and acquiesce (as some Dem strategists would suggest) we are not assured that the outcome will be any better than if we resist. Personally I believe that we must now think in terms of active resistance to the regime, peaceful protest is good and it builds confidence and community but the regime is not paying any attention. By active, I DO NOT MEAN VIOLENT resistance‼️ I am referring instead to action in the civic and economic space that would disrupt the oligarchic system and finally get the regime’s attention, yes I am calling for a GENERAL STRIKE on the part of the People of America 🇺🇸 to stop the cycle of compliance to tyranny‼️ Do NOT forget that our tacit compliance with this regime, by going to work every day and keeping out of trouble is NOT going to reverse the rapid slide into dictatorship that we are experiencing right now‼️ We MUST act in ways that DISRUPT, not in ways that SUPPORT and ABET the regime‼️ What they care most about is Power, Money 💰 and Control‼️ We have to start thinking about ways to weaken the regime, deprive them of those things they want and need the most‼️ Any actions that fall short of this objective are tantamount to capitulation‼️✊🏼😆

What a valuable lesson this is! Because this is how the SCOTUS majority intentionally and with malice aforethought misreads *everything*, including the 2nd Amendment and the 14th. Being neither a parent nor a grandparent, I wasn't aware of UNCLE BOBBY'S WEDDING, but I was very much engaged 30+ years ago when two of the first kids' books about gay/lesbian families came out: HEATHER HAS TWO MOMMIES and HOW WOULD YOU FEEL IF YOUR DAD WAS GAY? The local right-wingers went nuts. Two daddies tried to ban both books from one of the school libraries. In January 1994, I helped organize a read-in featuring those two books and others on the American Library Association's banned books list.

The read-in was a huge success. I read from HEATHER. A co-organizer read from HOW WOULD YOU FEEL. A local minister read the David and Jonathan story from the Bible. About 20 readers in total picked a passage from a banned book that resonated with them. Are similar readings going on today, on Zoom or in person? I bet they are. I hope they're happening in the front yards of SCOTUS (in)justices and maybe Ron DeSantis too.

Thoughts... Is it possible to establish a constitutional process consisting of 1) An independent national nonpartisan judicial committee to oversee the Judiciary, & to pre-qualify & establish a slate of potential Supreme Court Justice candidates for future election? 2) Similar to primaries, allow the American Voters to choose which candidates appear on federal level ballot from the Justice Candidate Slate. 3) Establish term limits for Supreme Court Justice seats, including the maximum number of terms they can serve. 4) During the federal general election, the Voters determine who will become future Supreme Court Justices. 5) Establish a recall provision to remove Justices that abuse their position for personal gain, conduct deceitful & unscrupulous acts, or committed crimes. 6) Establish an exit door strategy that removes the current Justices that have reached or exceeded the new term limits.

Virtually all Republicans who have held elected office since 2015 have shamefully violated their oaths office and have been derelict in their duty to serve and protect the American people. Republicans’ cowardice in the face of tyranny has caused harm to America that will take many years to correct. Rather than deplore the actions of Trump, they have supported him and hid behind him to avoid direct criticism.

The Supreme court is not our country's court. It should be renamed to trump supreme court. We now know that they are becoming more like the senate, who won't do the job they were elected to do, so I am afraid that they will do less and less according to our Constitution and more and more of trumps wishes. I sure hope I am wrong. I guess we shouldn't expect more because of the lies and crookedness of this regime and all that they have influence on.

How are we to unify the democratic party? Keeping a 2-party system is the legitimate method to defeat the Republicans who are such a unified party, but the Democratic party is splintering.
