The United States Supreme Court issued its biggest ruling yet against the Trump regime's invocation of the Alien Enemies Act. What process is going to be required? Is the Alien Enemies Act constitutional or unconstitutional? What did the Supreme Court actually address? What goes on next? We will address it all here on Legal AF,

I also want to talk about an oral argument that took place in front of the United States Supreme Court this week as well on the issue of birthright citizenship, but more specifically on the procedural issue regarding immigration.

All of this comes down to the fact that government gives the bare minimum to Americans such that 90% are too illiterate to remotely understand anything that Ben and Michael have said today.

Good governance is HARD. Legal issues are complex. Criminal Republicans exploit this general illiteracy by distilling it down to “immigrants and trans folk are at fault” and instead of putting in the work and doing what is hard and what is right, MAGA does what is easy and what feels good to them which is just getting angry and what they perceive as “owning the libs”.

I thank you both so very much!!! this from David Packman should be spread as well.

Government spending is up—way up—under Donald Trump. That may sound surprising if you've been listening to the rhetoric coming from the right. You've likely heard the endless talk about “draining the swamp,” about finding efficiencies, cutting pork, and slashing government bloat. That’s the illusion. The reality? Trump’s government has already spent $166 billion more this year than we had at this point last year under President Joe Biden. And this comes even with the so-called “efficiency” crusade led by DOGE—Trump’s flashy, Elon Musk-backed experiment in gutting the public sector.

So what happened? If DOGE is cutting services, pushing out workers, slashing federal programs—how is spending still skyrocketing? Well, let’s look at where the money’s going. Military spending alone is up $39 billion year over year. Remember when some on the left and even a few on the right suggested Trump might cut military spending? Never happened. Meanwhile, immigration and border enforcement have seen an $18 billion bump. Even if you think that’s a good investment, it blows a hole in Trump’s promise to reduce the deficit.

Then there’s Social Security and Medicare, up $70 billion. That’s not because of mismanagement—it’s because Baby Boomers are retiring and claiming the benefits they’ve earned. Cutting these isn’t politically viable, nor is it ethically justifiable. But the costs are real, and they’re growing.

This isn't complicated math. Trump is cutting small, inconsequential programs—$30,000 diversity initiatives, AmeriCorps, Meals on Wheels—while pouring billions into militarization and deportation. At the same time, he’s doing nothing to curb the big-ticket items, which continue to expand. So when Republicans say they’re cutting waste, what they mean is they’re cutting the stuff that helps people, not the stuff that actually costs the most.

Now let’s talk about DOGE. This was supposed to be Trump’s government efficiency machine, a Silicon Valley-style disruption of bloated bureaucracy. Instead, it was theater. Most of the so-called “cuts” were either fake—typos blown up into press releases—or rebranded Biden-era reductions. DOGE wasn’t fixing anything. It was sabotaging oversight, defunding watchdogs, and eliminating regulators that were inconvenient for Elon Musk and his allies.

It was never about money. The real purpose of DOGE was power. It was about giving Elon and his orbit control over the levers of government. They didn’t even try to hide it. Once their goals were achieved—neutralizing investigations, blocking lawsuits, seizing control of key systems—Musk stepped back, his mission accomplished. And DOGE? It’s winding down. The damage, however, is done.

We’re talking about deep sabotage. DOGE embedded operatives in agencies like the Treasury, IRS, and Medicare. They replaced hardware, restructured platforms, and introduced so-called “efficiency upgrades.” But what they really did was create long-term vulnerabilities. These systems will be compromised until at least 2029. This wasn’t modernization. It was about gaining access—and control.

Notice what DOGE didn’t touch: the Pentagon, Border Patrol, military contractors. They left the F-35 program alone but went after NASA and public health systems. That tells you everything you need to know. This was never about cutting waste. It was about seizing influence and weakening institutions that hold the powerful accountable.

And now, with oversight gutted and spending still up, Trump and Republicans are pushing their next big scam: the “big beautiful” tax bill. It’s the sequel to Trump’s 2017 tax cuts, but this time they want to make them permanent. The 2017 cuts, you’ll recall, were designed to sunset—temporary budget trickery to hide the long-term cost. Now they want to add trillions to the deficit by locking those giveaways in for good.

Trump came into office promising to run government like a business—efficient, lean, smart. Instead, he’s spent more than Biden, gutted accountability, and handed over control of key systems to a billionaire with a vested interest in dodging scrutiny. The cuts were fake. The purpose was real: consolidate power, reward allies, and kneecap regulation.

The next phase—if we don’t stop it—is permanent tax cuts for the rich, more weakened oversight, and deeper entrenchment of corruption. This isn’t fiscal responsibility. It’s a heist. And unless we call it what it is, and unless more people—especially former Trump voters—step up to stop it, the bill will keep growing, and the damage will take generations to undo.

Thank you both. I'm not a lawyer and I'm appreciating the law lessons you give so clearly and concisely which are based on what is happening right now around us and to us. Without this understanding we all stand to lose our rights and our democracy. Keep it up, and again many thanks.

Ben...you need to stop droning on and on and repeating yourself...it's tedious and off putting. Make you points, then move on ! I find myself screaming at you to SHUT UP. I see Popok trying desperately trying to wait you out. Sometimes he breaks in, makes your point for you, giving you a chance to end you rant...but you just pick it up again. I love you, but you seem to love your own voice even more.

I beg to disagree strongly!! It is actually Ben IMHO who is the best of all of The Meidas Touch Network. With all due respect to Michael Popok, it's him who sometimes tends to have either needlessly difficult or needlessly rapidly-spoken and mangled sentences. IMHO, it is Ben who makes the point better. It was Ben who finally said what needed to be said - that these issues are existential!!

Of course you're entitled to your opinion...but, again today I listened as he was preparing to have a convo with Litman. Ben went on and on for 5min, repeating himself several times, while Harry sat quietly, waiting patiently to answer the question that Ben repeated at least twice and while doing so, digressed to talking about several other off topic things. Ben is smart and makes great points and comes prepared but, OMG, he loves the sound of his voice. I mean this as constructive critcism...not to demean him.

Oh, Harry Litman whose main point in his few months ago Substack has been/is "let's not blame Merrick Garland" (unquote), although that same Merrick Garland had a 4 year long duty of his job to do yet he capriciously chose the dereliction, and here we are. Imprisonment of tRumputin and/or any of his coup-plotters would've been more worth than all the imprisonments of his/their footsoldiers, but, merrick garland thought the contrary, and here we are.

The thing is there should be a law against foreign nationals who are wealthy, can come for a huge fee, to bring their pregnant wives to the US so that their babies will be a US citizens. This allows the family, for generations, to be US citizens and foreign citizens that will be able to overcome laws that are prohibited for foreign citizens.

Terrific LegalAF today. Just getting caught up after being offline. If James Comey's seashell posting happened on May 15, 2025, please note that September 11, 2001 was 8,647 days previous. In other words, perhaps Comey wasn't making a threat, but rather commemorating a tragic date in American history that happened "8647" days ago, by spelling-out the number using seashells on the beach.

That's an interesting perspective.

Mr.Comey was on Stephen Colbert a couple nights ago and explained his experience. The 8647 was already on the beach, he and his wife came across it while walking. I'm sure there is a live clip on YouTube or Stephens page.

Thanks. I'll see if I can find the clip. Regardless of account the Mr. Comey has provided, I'm sure the MAGA nuts will, sadly, still investigate he who shares photography of seashells.

"Trump ruining America’s perfect credit score and the impact on everyone’s pocketbook" Worst is yet to come. Donald "The Beast" Trump is building a wall once again. Colossal tariff wall that is the beginning of the end for the system of down. At first the beast will pull the plug out of the global economy. The worst financial crisis of human history will pull a swarm of the banks underwater and the bank run begins. Then the beast will collapse a mountain of debt shattering the backbone of the monetary system causing a systemic risk to realize. Finally the beast will cast American citizens into a system slavery under the name of Ronald Wilson Reagan, just to "honor his legacy" count the number. After the destruction a new world order will be established in the US. And the Golden Age begins from the ruins of the world wide collapse. All of the system slaves will love it. No more cash - just digital transactions. No more traditional criminal activity. No more tax evasion. No more transactions without the "all seeing eye". Outcasts will hate the world without freedom, hope and privacy. To cover up the mess and distract the public by smoke and mirrors, the beast will engage in a war with Iran. Lies and deceit, corruption and decay, dancing on the graves will continue. Until; Black hole sun, won't you come, won't you come... I want to play a game. Time has come to opt out of the empire of filth. Live or die...

What the hell is wrong with Sauer's voice? He and RFK have the same gravelly voice...did they both take the same drugs or have the same brain worm? Love that the administration lawyer was questioned by SCOTUS in a way that basically spanked him verbally.

In front of his generals, Stalin tortured chickens and then threw seeds in front of the injured birds and laughed that they ate from the hand that hurt them, by way of intimidating his military leaders who were the only ones with the power to take down his regime. Extrapolate.

Can there be a nationwide injunction blocking Donald Trump's attempt via an executive order to get rid of the constitutional right to birthright citizenship framed the way I just framed it, which is accurately, it's a pretty shocking case that it even got to the Supreme Court, which a number of justices basically looked at the Trump regime and said,
