Legislators supporting the bill say it’s an effort to prevent those “who actively seek to do us harm to seize control and dictate their terms over our economy, supply chain and our daily lives.” The bill is targeted at Chinese, Iranian, North Korean and Russian nationals, with a provision allowing Gov. Greg Abbott to tack on additional nationalities.
Government bodies have tried to legislate who can own property since the nation's early days. But if history is any guide, such laws are both hard to enforce and difficult to legally defend.
Amid a wave of anti-Chinese worker sentiment in the mid-1800s, a number of Western states enacted alien land laws to prevent Asian immigrants from purchasing or leasing land. That culminated in The Chinese Exclusion Act of 1882, which stopped Chinese immigration and barred them from U.S. citizenship.
But a wave of Japanese immigrant laborers soon arrived, leading to the Immigration Act of 1917, again limiting immigrant rights. States soon followed with legislation barring Japanese-born citizens from purchasing property.
Immigrants got creative to skirt the laws. Families bought land in the names of their American-born children. They also took their fight to courtrooms, and the Supreme Court eventually struck down alien land laws in the early 1950s.
About 75 years later, Texas' Senate Bill 17 is headed back to the upper chamber. And while its aim is not as draconian or expansive as some of its forebears, we’ll be keeping a close eye on whether it survives the Senate and if it can find a path to judicial support.
