You guys need to be made aware of this: As of this morning there appears to be a video circulating of Lev harness vocally denouncing Midas in general & Cohen in particular without really being specific about what his issues are & upon close examination of the video it seems to be faked at least in that the voice audio does not match the mouth positions on the tape, & it doesn't just look like the track has slipped or is not exactly lined up the way you will see the tracks sometimes not perfectlined up, up, it just looks like there is some sort of fake voice, perhaps AI generated, of Lev put over existing video of him & in the interests of transparency, IF this is fake you need to be made aware of it, but obviously if this is real you & Aaron need to address this because if someone has done this, especially on Christmas Eve, this is a new low to which they have sunk. But it's something you need to be aware of & that you address it as early as possible. Hope the holiday and the New Year find you & your families well. Keep up the good work….

I had seen something earlier this morning on someone else’s post about a falling out between Lev and Michael Cohen and I couldn’t figure out what was going on. My guess is it is fake then. I can’t imagine two people on the same side of democracy, causing such a rift. Another fake DOJ posting?

WELL, I'M EATING CROW THIS ECCHSXMAS AM, since finding out the Lev rant WAS real, He & Ben had it out yesterday & it's a bunch of internal politics but much of it seems rooted in Lev's concern for Midas's resources not being put sufficiently toward the interests of Ukraine. And Cohen & Epstein (& the "Katie Johnson" issue which was something I've been harping on concerning Cohen & his Inside Knowledge of Dumpster Central). I'd have to find the link and see if I can post it here but OY it's the last thing we need right?

I watched a video that I believe was on a young lady's platform. Cohen and Lev's son and someone else was on it. At the time I didn't have sound and there wasn't a transcript. It was difficult to follow using the captions. Cohen looked very angry.

From what Lev said he was unhappy that his son was not aware, I think, of what the program was to be about. ???

I hope they can iron out their differences.

Oh, and lastly. In terms of the United States. We must never salute and show respect towards the American flag. The United States was founded on genocide and built with slavery, with the United States empire responsible for countless deaths. The American flag is soaked in blood. The only time to smile when in the presence of the flag is when it's on fire or being torn to shreds. When it comes to holidays like Independence Day, Memorial Day and Veterans Day, that they are not worth celebrating as they are about brainwashing people that the United States is a great country and reinforcing that lie for those who already believe it. These holidays, I would argue, are primarily about selling and reinforcing the lie that service to the United States military industrial complex somehow made the country and that of the world a better place. After you take the time to learn about the history of the United States and its actions, you'll hopefully come to the same conclusion that I have, which is that there is NOTHING honorable about choosing to be a pawn for the military industrial complex in service to the bourgeoisie, or capitalists if you prefer. The fact of the matter is that the United States bullies and terrorizes the rest of the world as it refuses to take care of its own citizens, because of this I can't help but look at the United States' flag in disgust. The ONLY time when it was acceptable to support the troops and that of the military was during WW2. That's it. But even then, the United States didn't win the war. The Soviet Union did. The United States just swooped in at the last minute to do some minor cleanup and took all the credit. Almost immediately after the dust settled, the bourgeoisie wasted no time in stabbing the Soviet Union in the back by spreading anti-communist propaganda to get the public to fear and hate everything that gave power and any resemblance of freedom and prosperity to the proletariat. Now, if you know someone who has "served" and was injured or killed. Don't get mad at me for speaking truth to power. Direct your anger towards the United States government for sending them off to die in a pointless war, conflict, or military operation that the United States instigated. Let me be absolutely clear. Although I disagree with Veterans and military personnel, in general, for their choice to be a willing pawn for the military industrial complex who I feel are undeserving of an honor, that does not mean I hate them. Unless they were participants in war crimes and are proud of slaughtering people, whether directly or indirectly, that's a different story. People who are proud of killing others who wish they could do it over and over again, those are sick and twisted individuals. That caveat aside, I believe everyone deserves to have their needs met with a government that actually cares about the well-being of people both here and abroad. In conclusion, the underlying reason for all these wars and conflicts is that the United States needs oil to back up the petro dollar. Without the dollars influence and buying power, the United States loses most, if not all, of its hegemony and economic stranglehold over others. So, basically, the problem is that of capitalism. With that said, though, by no means does that mean other countries are innocent in their foreign affairs, but the United States is by far the worst. It's not even a contest.

Kevin you obviously understand what is being attempted here by the regime.

Some suggestions on how we can organize, some hybrid model using some of the current wins like the major of NYC. Is there a way to move forward? attracting some wealthy folks that can see the writing on the wall and do not want to let 2025 happen. Can we organize the online substack media? Is there a way to force a united front against this before it is completely running the game?

Can we get Mamdanie -LIKE organization to push democrats ahead with a program that will insure healthcare for all, equitable taxation system that will support rebuilding and uplifting the middle class and poor. Obviously other key supports would need to be in place as well

I've said that millions must remain vigilant with rallies against these autocrats bent on total control of resources, power, and aganda. We're not quite thru with some aspects of a democracy and there's large numbers that have faith that there will be elections in 2026. I believe that there will not be elections. The supreme court might have enough back-bone but oit may only be a matter of time before the regime goes against their rulings

Marshall Law could be lurking around the next corner. Is there enough retired military and some on the job now that will not follow the regims order to shoot to kill which what might be expected at another mass rally. Until we talk about options and organizing there will be no magic wand. This regime is splintering but the next folks behind them are definitely much worse. This is why we need a plan of action because there will be many rules and laws ignored and we need to be in the front of the line and not on the sidelines when this happens.

I find the recent political wins both clarifying and enigmatic but all create opportunity. I’m not sure I can improve on what you have written so well, but may I can add to it?

Big races. NJ and VA governors' races (and greater state House (VA) and General Assembly (NJ) control); Mamdani as NYC mayor; CA Prop 50. Small but important races. 2 Seats GA’s statewide Public Service Commission; PA: 3 Supreme Court judges retained (and victories in several county races); MS state GOP senate majority broken; also wins in FL, CT and NC. To some extent, this broad-based change of control (NSEW) as well as in wealthier and less wealthy states, urban and rural areas and across the blue-purple-red spectrum suggests to me (of course not just to me) a strong elect the Dems who won (I would not bet on this theory) or rejection of all things 47 and aligned (to me, likely). Maybe both.

To your more pointed question, I think the answer is consistent and frequent messaging that demonstrates what will happen and how, since bilateral cooperation is not a given. Messaging must be “we hear you and here is how will help you” not “they are even worse than we are.” Include all media: social media; podcasts; print; MSM – wherever people go for information they trust (whether or not trustworthy, many will rely on it). As for substack organization, I defer here to the far more competent than I Meiselas Brothers (MTN).

Your question about organizational lessons intrigued NGO organizations such was what was USAID and similar organizations such as the Peace Corp. 1964 Freedom Summer. We need to rebuild the U.S.

As for 2026 elections, I think your point is excellent. I am close to you, just at a slight distance, though it really amounts to a distinction without (much of) a difference. I think there will be the illusion of voting (and legitimacy) to avoid front-end rebellion. No GOP problem if they appear to win (we likely never would know) and if they lose, they will declare the elections fraudulent and unreliable, and will declare victory. Game over.

My suspicion is that you may be correct in suggesting martial law as necessary. My question then is whether at the direction of this CIC, with the US military being aligned with him, or based on the constitutionally mandated obligation to refuse to obey illegal orders such that we end up becoming a full banana republic after a coup d'état, the duration of which may be limited (one hopes) by stable democratic resurgence.

As I reread this, I am not convinced that I improved in any meaningful way on your thoughts. If nothing else, mine may be consistent and join yours. Please feel free to add additional thoughts as, of course, anyone here is welcome to do. Here’s to hoping! Have a great holiday season.

Pardons Can Include, Create, Or Cause Collateral Legal Risks

Although the president’s power is broad, it is not without accepted limitations. Perhaps the most important is that the president can only pardon federal offenses; he cannot interfere with state prosecutions. Also, the pardoning power only extends to criminal offenses; it does not preclude civil actions. ... Whenever it issues, a pardon will not interfere with any rights a third party has to recover damages for another’s criminal behavior even if that behavior has been forgiven by a pardon.

In the 1915 case of Burdick v. U.S., George Burdick refused a pre-emptive pardon issued by Woodrow Wilson because accepting it would have meant that he could not claim his Fifth Amendment privilege when called to give testimony relating to the pardoned crime before a grand jury. Herein lies the downside for President Trump in any pardons he might grant. Should Congress or the Justice Department seek to determine whether the president or any of his associates acted criminally before or during Trump’s term as president, pardoned individuals would be limited in their ability to dodge questions by claiming their Fifth Amendment privilege.

The broader the pardon, the narrower the Fifth Amendment protection. To a degree determined by the scope of Trump’s pardons, recipients could be required to flesh out details about crimes for which they had been pardoned, perhaps implicating others whose involvement had gone undetected. If they then lied to avoid shaming themselves or to protect others, they could be tried for that crime.

[P]ardons cannot insulate a president or others in his or her orbit from non-criminal investigation and potential liability. A presidential pardon does not affect federal civil or administrative proceedings, or state criminal or civil actions. I think your observations are spot-on, though so often I have to question what settled law (stare decision; let things decided stand) means under the Roberts Court. Roe v. Wade?
