Who is enforcing these judgements? Trump doesn’t have a good reputation for obeying the law, and neither he or his henchmen really care about the damage they are doing to our country.

Adam Knight's avatar

Very good point.

Enforcement is critical!!!

Daniel Solomon's avatar

The courts use the US Marshals' Service.

Civil judgments are processed through remedies like garnishment. https://www.nolo.com/legal-encyclopedia/how-creditors-enforce-judgments.html

Musk is a private citizen and probably has no immunity. Yesterday, a federal judge temporarily blocked a Trump administration team led by Musk from accessing government payment processing systems in response to a challenge from the attorneys general in 19 states. Complaint.'https://ag.ny.gov/sites/default/files/court-filings/state-of-new-york-et-al-v-trump-doge-temporary-restraining-order-memo-2025.pdf

Do the US Marshals report to the current DOJ? If so, doesn't that mean that Trump can stop them from enforcing the law? (I hope this is not the case).

In the meantime, the more We The People work together, the less power they will ultimately have.

Daniel Solomon's avatar

If they don't follow the judges' orders, they'll be in contempt. Using the power of civil coercive contempt, can be jailed until they comply.

Funds for the federal judiciary are included annually in the Financial Services and General Government (FSGG) appropriations bill. https://www.uscourts.gov/data-news/reports/annual-reports/directors-annual-report/annual-report-2023/funding-and-budget-annual-report-2023

If they refuse to fund the courts, the courts can hold the administration in contempt.

Pending motions to unfreeze funds. https://riag.ri.gov/press-releases/attorney-general-neronha-files-motion-enforce-court-order-unfreeze-federal-funding

I believe that if Dump himself ordered Musk to intentionally break the law then there would be no immunity possible for him or for Dump. But Dump could also claim he was doing “official business” for the president and even if the courts threw that out he could still tangle it up the courts, probably for years. These new moves by the courts are good and are not going to be so easy for him or Musk to just dismiss. Many of them will stay in place until the final outcomes of any court proceedings, appeals, etc. and again that could take until the end of his term, easily, and hopefully.

Charmaine Webb's avatar

According to Wikipedia the DOJ is their parent agency, but they work for the district courts. They report to the judges.

Ellen's avatar

Yes, they are directed by the U.S. Attorney General who is Pam Bondi........you think she will direct them arrest Musk???

The president appoints the head of the US Marshals Service. The one appointed by Biden in 2021 retired: Ronald Davis retired from the U.S. Marshals Service on January 17, 2025.

US Marshall's Service =6100 sworn and unsworn people who work for the President trump's Executive Branch-The Justice Department. Marshalls need orders to act and are not Lone Ranger, Superman coming to save the day.

Civil/State enforcement is even more easily blocked by threats, blackmail, violence-you know the MOB stuff.

There will be no illegality, criminal act, indictment, sentence that cannot be remedied by the absolute power of a Presidential Pardon.

1500 insurrections including violent ones sentenced to long prison terms-free to roam again, Madoff, other buddies of grift, crime trump has already pardoned.

trump will resign and President Vance will pardon him.

Do you see yet that courts will not be the answer? Don't go down the wormhole again to wait and wait for justice to be done!

We the People are the ONLY answer. MLK, Gandhi and millions of other leaders have changed the world with non-violent resistence. Followers used nothing else beside what they had-voices, purchasing power, bodies. But millions together can do it with perseverance and brave sacrifices.

Anna B's avatar

Madoff petitioned trump for clemency - it was never granted.

Dennis Ryan's avatar

January 6 ers thought violence was part of equation. $ is a 4th branch of gov, sort of. When screwed, it screams. Military is another “ sort of”. Plus, many voters did not vote and half who did were not for this. All actions against Heritage/Leo/Republicans/Trump/Musk seem worthy; all of them. Judicial, local/state, Congressional, media, and then of course there is the wrenches in the cogs of industry….

Allen Abrahams's avatar

He also ordered them to destroy what they took.

BMooreCan's avatar

My questions are is it too late? Will they comply with destroying the information? How can we be sure our information is being protected?

Joan Boling's avatar

Welllllllllllllll it snows in July

Sue Sanders's avatar

How can they tell if information is destroyed, or not transferred and then 1 set is destroyed? I want to know how the cyber police are monitoring the hackers. Man, we can’t afford to dismantle any of our trusted FBI servants. Crash Patel!

Mack's avatar

But Trump could pre pardon Musk. Isn't that what Biden did with the J6 investigative committee members?

Michael O'Neill's avatar

The US Marshals are obeying Musk and Trump's orders to escort government employees out of their place of work. What makes you think they'll turn around and enforce judgments against Trump?

DG's avatar

And Musk is p**sed about it too. To showcase his total lack of understanding how the American judicial system works, Elon's calling for the judge who issued the order yesterday morning to be impeached! Darn that judge for correctly doing his job!!

Daniel Solomon's avatar

I'd issue an order to show cause why he should be held in contempt and order that he appear ASAP.

Sally Skellington's avatar

Lead by musk 😂. A boy with money that's all he is.

Paul's avatar

Musk’s “immunity” is a pardon from Trump for criminal acts.

There is no pardon or immunity for civil penalties. Or, for violation of State laws.

The latter is tricky. Will it be possible for state prosecutors to bring state criminal cases against him for what he is doing? There seem to be state charges developing against some of the pardoned insurrectionists. But whether those are viable remains to be to be seen.

Daniel Solomon's avatar

Depends on state law. There are lots of mandated funds, matching funds, etc that may be affected.

I'm still expecting there will be tort actions stemming from election interference.

Joan Boling's avatar

But how did he find out so many $$ sent out with out social security numbers. THere is a pocket gadget that can read our SSN numbers etc even through metal?? One 19 year old in our stuff has a background for that kind of thing.

You must realize these are not ordinary people whose actions can be logically explained. Much of this information was out there before the election and almost a third of the registered voters didn’t vote.

Eileen G's avatar

I still can’t wrap my brain around those 90 million registered voters not voting!!!???

I saw a podcast yesterday with George Conway that was very disturbing. He said that both trump and elon don't care about the laws. Even if the judges rule against them in these cases, they probably won't comply. And who will make them do so? If they are held in contempt, or ordered to jail for not complying, the US Marshals are the ones that will enforce those edicts.

However, the US Marshals fall under the Justice department, which falls under the Executive Branch. Therefore, it isn't going to happen.

Then we will be in a place where laws no longer matter. If they don't apply to some, why should they apply to anyone else in this country? There will be chaos.

Also, what keeps trump from leaving office?

He said that the only way he sees the possibility of change is if there is a public outcry and revolt.

I'm sorry to be such a Debbie Downer after reading your uplifting newsletter.

Meredith's avatar

I listened to that this morning and I have to agree both with you and Conway; The People are really the only refuge from chaos and the complete abolition of the rule of law ... this, however, leads me to visualize innocent people being killed by the military called up by Trump via the Insurrection Act (to give him cover; he obviously doesn't care about the actual legality...) as in Tiananmen Square and the tanks. This is not an impossibility any more and you're not being a Debbie Downer to talk about it.

Pamela Rhodes's avatar

I also viewed George Conway’s podcast. Despite the content being quite unnerving, it did highlight the power of Americans through their voice and great sacrifice which has been displayed for decades. Presently, America has been effectively hamstrung. We, the People, are the last barrier to the complete hijacking of our Constitution and our democracy.

Becca's avatar

George Conway is not my favorite source because of his ex-wife but he is smart and tells the facts as they are.

This is it.

And Presidential pardons cover Musk, all Cabinet heads, any buddies of trump and coupmasters.

Pardons have no limits, no restrictions. They are absolute in the US Constitution. Should have been limited by Amendment decades ago. Put it on your "to do" list if We get our nation back.

Gabriele D's avatar

Thank you. I had forgotten that George also mentioned pardons for everyone. To possibly include Trump pardoning himself.

Becca's avatar

Trump will resign before very long and President Vance, clean handed (ha) will step in and pardon trump. No problems at all for trump.

ZCob's avatar

Gabriela… I saw the same. We only have democracy ( ability to live in a republic nation and globally), if we agree on civility, a set of not just parameters)but agreed rules of law.

Every house every home, every institution will always require ongoing evaluation. Improvement always helps the house stand better.

We have always been diverse. ( even a man and a women to me is thr most diverse relationship there is).

Wanting power is greed. Wanting money is not evil. Wanting wealth at the expense of everyone else is evil.

We are needing to climb up the mountain every day.

We are strong. We are one in this… together!

Reese Erwin's avatar

We must face truth and it’s a downer. THEY WILL NOT COMPLY AND THERE IS NO ENFORCEMENT. Weak Dems didn’t do enough to prevent the last 3 weeks from happening. They could have blocked, delayed and obstructed as Indivisible has urged. Yet, they acquiesced and many voted for the horrid, evil, unqualified nominees. Schumer and Jeffries are weak leaders. We’re in a war. Our democracy is at stake. Not a time to be worried about being nice and observing protocol.

Ann Adler's avatar

I was with you until your last sentence. Where I would disagree with you is that “we the people” let it happen. Maybe not you and me, but collectively, it happened because people voted for Trump. They chose the con.

Becca's avatar

You actually get it. US Marshalls are 6100 sworn and unsworn people spread around the US. They usually deliver subpoenas. Unsworn employees are what. Do they follow any code, take any oath to US Constitution, law/order-what just hired bodies?

Reese Erwin's avatar

But they report to the US Attorney General. Guess who: Pam Bondi, a total Trump loyalist. She will do whatever he wants.

Get Er Done's avatar

Good morning Meidas Mighty and fam.

That’s my question. Even though it’s court-ordered, how do we know if they’re destroying the information they’ve obtained thus far? 🤔

Please help me understand that. Because like Larry M. said, Trump and his goonies care NOTHING about the law.

Have a good Puppy Bowl and Super Bowl LIX day! 🐶🏈

TrueCanuck's avatar

There is no way of knowing that the stolen information has been deleted other than the promise of the rat himself. It's a pretty safe bet that the material was compressed, encrypted, and shipped off-site for layer dissemination. Encrypted, because there's a huge market for that information, and he isn't going to let it go for nothing. Given that his kids have been in there for days gathering information, it's unlikely that the cease and destroy order is worth the paper it's written on. While the rat of musk persuasion isn't smart enough to know how to get the information out, his kids would. It isn't hard. But it will be untraceable.

Reese Erwin's avatar

Court ordered? So what. Who’s going to enforce it? US Marshalls, who report to Pam Bondi, who does whatever Trump tells her.

Scooterboi60's avatar

Court marshals are there to enforce the judge’s rulings and don’t forget, the fraudster and his little company still have a monitor installed checking on his business movements that he hasn’t been able to get rid of.

Daniel Solomon's avatar

IMHO Musk has to be the greatest target defendant of all time.

Exposed to damages for election interference under state law. Usurped the powers of the government? Product liability for flaming Teslas?

Becca's avatar

US Marshall are controlled by trump's Justice Dept. not the court's. There are 6100 Marshalls spread around the US. Some are sworn, some unsworn-just bodies. They bring in people who have fled bond, serve subpoenas, little stuff.

Nothing is illegal anymore for trump and all his coupmasters. Presidential pardons will erase any consequences to current criminal actions.

Don't get it yet? Think Russia, China-see any law/order, enforcement that impedes autocracy, oligarchy, kleptocracy there?

We have no law/order, justice, consequences because no enforcement or Presidential pardons make them a farce, a ruse, a comedy, a novel, a play, illusionary things, an idea.

Terazel's avatar

We can thank the SUPREMELY CORRUPT Court (of fools) for much of this. But the Judicial Branch is our only hope and so far, they are doing the job.

Reese Erwin's avatar

Don’t count on it. With Pam Bondi as Attorney General, she’ll do whatever Trump wanats.

Becca's avatar

This is a cut and paste of a previous post.

There is NO enforcement power vested in court verdicts, orders, rulings.

DOJ, FBI, must enforce what the courts order. This is the way USA set up the powers of justice--so courts do not have too much power.

Musk, GOP, MAGA politicians in states etc. know if they stick close enough to trump/Heritage/Musk objectives they will make $$, get power through criminality and will get a Presidential pardon for their behavior.

Musk probably has his pardon already or he can blackmail trump/Vance into if with trump's private info., taxes, FBI investigations etc. You have to think like a powerful, wealthy, connected person and pretend you are that person.

Abstract, critical thinking and curiosity show you what they MAY do not what they CAN do.

Skygazer77✨'s avatar

🙌🏽⏰🔥⌛️⚖️🆘 If we acquiesce then we are done. And, given that choice most ppl will want to continue to oppose this coup & will view all the dirty deeds as provisional and not permanent. Who wants to just let Felon47 just walk in & Steal Everything We Hold Dear? Not me!!

I'm with you. The Economic Boycott February 28th is real I was notified by a local resistance group.

U.S. Marshals report to Pam Bondi now, who does whatever Trump tells her to do. Guess what will happen? Not good.

I definitely would like to see a “War Room” for immediately responding to disinformation, misinformation and outright lies. Like Karoline Leavett’s snarky comment that Federal Workers are ripping taxpayers off and should think about working in the private sector where they can be more productive. A blanket insult she pulled from where?…don’t let her get away with that. Someone should ask her why she’s insulting 2 million plus people she knows nothing about. Make her the fool

for saying it. Every time…

Pepper69's avatar

Absolutely!!!! The messaging, attacking the lies and propaganda needs to begin before trump and right wing media began shaping the narrative. Their narratives are so predictable that it can be done. Yes MTN is awesome but the war room with everyone being on the same page and overloading social media at the same time with the initial responses will help weaken their attacks tremendously I believe. I believe this is what Jim Acosta was referring to.

Cindy K's avatar

We absolutely need a team to combat Every Lie within minutes with cold hard facts. In the past the Dems would debunk One Lie 3 days after it came out. In the meantime there would be a thousand more lies out there. Love the War Room idea!
