As I understand it, Congress gave the President the power to levy a tariff on an emergency basis for a period of 4 months. Has this grant ever been challenged as unconstitutional ? Also, it is obvious by now that none of the justifications so far can withstand an evidence based hearing as clearly not emergencies within the meaning of the statutory grant.
