Two courts have declared that it was unconsitutional.
"U.S. District Court Judge Fernando Rodriguez Jr. is the first judge to rule that the Alien Enemies Act cannot be used against people who, the Republican administration claims, are gang members invading the United States.
“Neither the Court nor the parties question that the Executive Branch can direct the detention and removal of aliens who engage in criminal activity in the United States,” wrote Rodriguez, who was nominated by Trump in 2018. But, the judge said, "the President’s invocation of the AEA through the Proclamation exceeds the scope of the statute and is contrary to the plain, ordinary meaning of the statute’s terms.”
"In an unusual late-night order, the Supreme Court temporarily barred the Trump administration from deporting Venezuelan migrants being held in Texas using an 18th century law called the Alien Enemies Act. The order came in response to an emergency petition filed by the ACLU, with Justices Thomas and Alito dissenting. John Yang speaks with Amy Howe of SCOTUSblog for more."

You are incredibly polite about all this. I saw the PBS segment. Nevertheless, the regime continues to harass and arrest people, like the Mayor of Newark, on very vague charges. It seems to me that a big part of this is forcing people to defend themselves so less attention is paid to the actual wrongdoing of ICE and their deputies.
I wish people understood even the basics of civics. I don’t know how many times I’ve explained impeachment and how the agendas are set.

Show up, and if necessary put your own body between the enemy and the younger demonstrators. What the mothers & grandmothers did in Portland during the year of street fighting. I'm 80 YO and I play the trumpet in a demonstration band. The music makes a safe space when things get crazy.
