SPEAKER 1
This is Michael Popak, Legal AF and the Midas Touch Network. We got some breaking and startling news coming out of New York and the Manhattan DA's office asking Judge Mershon, who was the judge presiding over the 34 count felony conviction of Donald Trump. And we were waiting on today's order on immunity and the sentencing,
0:19
which was scheduled for the 26th of November of Donald Trump. Well, all bets are off now. The Manhattan DA, following the lead of the special counsel in the federal prosecutions of Donald Trump, have said that this is unprecedented circumstances with their convicted felon defendant being elected to be the president. that it impacts constitutional issues, presidential transition issues,

and they want more time to consider it, just like the special counsel did Jack Smith when he filed his most recent paper in front of Judge Chutkin, asking until December to get back to her on how they want to handle whether they continue the prosecution of Donald Trump. But here we were anticipating today,

Popok Breaks Down Major Update in Trump’s NY Criminal Case [Ad-Free]

Michael Popok analyzes Justice Merchan's latest ruling in Trump's NY criminal case in this exclusive ad-free hot take on Meidas+.

A major development was announced in Donald Trump’s New York criminal case this morning, and Legal AF host Michael Popok is providing the latest updates and his expert legal analysis in his latest hot take on the MeidasTouch Network. The presiding judge, Justice Juan Merchan, has granted an emergency stay, halting immediate proceedings and delaying the much-anticipated sentencing originally set for November 26. The decision follows a request from the Manhattan District Attorney’s office, which cited the “unprecedented circumstances” of Trump’s potential return to the White House and the constitutional complexities this situation presents.

Popok explains that Judge Merchan was initially expected to rule on Trump’s claim for immunity concerning activities dating back to 2016. The immunity ruling could have provided clarity on whether Trump could face sentencing while preparing for a presidential transition. However, with Trump now president-elect, the Manhattan DA's office acknowledged that a review of the case was essential, as it raises new questions about presidential immunity.

Judge Merchan should have sentenced him in September when it was initially scheduled. His fear of impacting the election may have destroyed this country. There were people who didn't know he was convicted because certain media outlets didn't report on it. Had he been sentenced, they probably would have had to report it.

If the Great American Experiment fails this time around, Judge Merchan will be on the long list of those who could have done something within their purview and failed to stop trump because they were afraid of how it would look.

In the interest of justice? Really? Justice is truly dead in the U.S. It would seem everything is still legal AF for oligarchs... as has been for most of history. Greatness? Nope. Fresh out. Check again in 100 years.

I can’t stand any information about this orange clown. I. Just. Can’t. I have decided to just not participate in this traitorous country anymore. I shall ignore everything that happens for the next two years and peek out from under my rock for mid-terms. Then, as I can’t listen to his voice, crawl back under. I’m ashamed of America. I’m scared for America. I am TERRIFIED to lose my Medicare because I know it will mean a slow painful end to my life. So maybe I will be over before mid-terms, let alone the next general election.

There won’t be an America in 2-4 years.

Same here Donna. That’s what they want. They want those who are over 65, have chronic illnesses, are poor, aren’t Christian Nationalists, look different than them, or disabled in any way to just “be gone”. I’m so very frightened for my daughters and my grandchildren.

This is when we have to start merging our lives. People who are property rich, but cash poor need to merge their lives - find each other, sell one house, put the other house in both names and use the other house to live in and the money from the 1st house to live off of that money - pay for medicine, taxes, food, what both need. Working on an app already - like a dating app, but for surviving the incoming administration!

normalcy bias - The phenomenon of disbelieving one's situation when faced with grave and imminent danger and/or catastrophe. As in over focusing on the actual phenomenon instead of taking evasive action, a state of paralysis.

Normality bias, is a cognitive bias which leads people to disbelieve or minimize threat warnings. [1] Consequently, individuals underestimate the likelihood of a disaster, when it might affect them, and its potential adverse effects. [2] The normalcy bias causes many people to prepare inadequately ..

More Bull shit! Like Merrick Garland...It starts out with great respect for the judge, kind words and so many behind the man thinking he is a good man and will hold the criminals accountable, and like Garland, in the end, he's just a cheap suit. A hack! He has failed America, just as the supposed hypocritical leaders on both sides. Very few of these assholes in office or on the bench are worth a damn and in the end, are no better than Trump. No accountability...lots of excuses! Fuck them all!

I wish I could say that I am surprised. What's worse is knowing that Trump is no aberration. All bets are off. He really is above the law, and that's a scary thing. Keep your eyes, ears, and mind open for the inevitable hellscape. We will certainly need to keep our wits about us.

I think tRump should still be sentenced on Nov 26th to 45 days in jail and immediately remanded to Rikers at time of sentencing, without any possibility of turning himself in at a future time. He can serve his sentence in full prior to inauguration and we can all move on.

Sounds like another cowardly DA is trying to find a reason not to sentence the convicted felon. He's not president yet, lawsuits may prove he's not after all he incited an insurrection which prohibits him from the position of president, and his immunity doesn't extend to civilian acts.

Let him run the country from jail if you have to but sentence him.

What did you really think was going to happen though? Trump will get away with this. Is it unfair? Yes. Is it wrong? Is it a miscarriage of justice? Is Trump above the law? Yes, yes & yes. Also, these people have to worry about their actual lives & the lives of their loved ones. It’s not right yet here we are. Unprecedented by an un-president.

Yes, Sean did some horrible shit, but Orange Woodstained Stalin committed crimes against the United States by covering up an affair to win an election, stole top secret documents after inciting a coup because he didn't want to accept the results of the election he lost. What do they think is going to happen this time around? If he doesn't die in office from advanced Dementia first.

Wow. So he wants an orderly transition. I seem to remember an insurrection to prevent any transition in 2020 when he lost. Put him in jail for crying out loud. He was found guilty by a jury. He's a criminal. As for transition, he's not going to do anything. The plan is made, the people appointed. What transition?

“Unprecedented” has been overused with Trump. He breaks laws then uses specific parts of the very judicial system to stay out of jail. Laws need to applied equally to all, regardless of their standing.

This shows the legal system has been either bought, persuaded, scared off or just incompetent. How much tax payers money has been wasted chasing candy floss. It makes a complete mocker if the judicial system in America AND if you are rich enough you can get your lawyers to get you off the hook, so it only is there to punish those lesser people!!

Trump is not currently the President, so what is Trump talking about? One day in court to be sentenced will not impede the transition. Nothing he did and was charged with was part of his Presidential duties. The law cannot be bent to fit what Trump wants. Delay the actual sentence handed down until he is no less anger president.

Expand full comment
Alice K.'s avatar

He himself is impeding the transition by not signing a required document. So how can he effectively use the transition as a reason he can’t be sentenced. I’d be happy to see him have to spend some time in jail, even if it’s only a month or a couple of weeks. The sooner he’s sentenced, the less impediment it will be to the transition.
